Re: P is a judgment by Moylan J (in his capacity as one of two judges from England and Wales designated to the International Hague Network of Judges) provides a practical guide to the procedure for recognition or registration of an order made in another Contracting State under the 1996 Hague Child Protection Convention. He stresses the need to apply the procedural rules with a light touch.
The orders were originally made in the Australian High Court, and the UK order is essentially a mirror order. It provides an interesting practical guide to the process. While emphasising the need for due process, the judge dispenses with certain procedural requirements in this uncontested case: “it will often not be necessary to have the raft of documents and information as required by the rules”.
