Sperm donor need not be recorded on birth certificate.

Mondaq reports that in a recent Queensland case two female parents of a child were recorded as parents, with the name of the sperm donor removed from a birth certificate. This is the case even if only the biological mother, or the biological mother and the sperm donor were initially recorded on the birth certificate.

In the case of A & B v C [2014] QSC 111 the children of a same sex couple were born before the law was changed in 2010 to allow same sex couples to initially be recorded as parents on birth certificates.  However, the court allowed the name of the sperm donor to be removed from the birth certificates of births dating from 2004 and 2006 respectively.

It is worth noting however that a Court exercising jurisdiction under the Family Law Act 1975 (Cth) may make orders for a child to spend time with a sperm donor (and, therefore, a child’s biological father), even if they are not regarded as the child’s “parent” and not recorded as a parent on a child’s birth certificate, provided the Court considers this to be in the best interests of the child.
