In Australia, divorce is based on a "no-fault" system. The only grounds for divorce are the "irretrievable breakdown of marriage," a provision introduced by the Whitlam Government through the Family Law Act 1975. To apply for a divorce, couples must have been separated for at least 12 months. In some cases, it is possible to be considered separated even if you are still living under the same roof as your spouse.
Either party can initiate proceedings, or they may submit a joint application, sharing the cost. If one party applies alone, they will bear the cost, while the other party only needs to sign the relevant forms upon receipt of the documents. The application process is separate from matters such as property division, child living arrangements, time with each parent, child support, and spousal maintenance.
Finalising the settlement of property or parenting orders is not dependent on the completion of legal proceedings, as these matters can be addressed as soon as separation occurs. However, when proceeding with a legal separation, the court must be satisfied that proper arrangements have been made for the care and welfare of any children under the age of 18.
There is typically a delay of around 2 months between filing and the hearing date. One month and one day later, a legal order is issued by the court. This order is required before you can remarry.
