Who decides what’s best for the children?

A recent report on post-separation parenting to the attorney general recommended children under two years should not have overnight time away from the primary care-giver unless it’s necessary. In high conflict cases before the family court, no overnight care is appropriate before the child is three years old. What has been largely missing from the same-sex marriage debate is a consideration of the rights of children. A recent study by Lixia Qu and Ruth Weston of the Australian Institute of Family Studies analysed data collected on almost 5000 children across Australia, from the time the children were 4-5 years old until they were 8-9 years old. The researchers found that children whose parents were married are more mentally and socially developed than children whose parents are not married.

Divorced fathers will not get legal right to access

From The Guardian in the UK, about the recently released The Family Justice Review report dashing hopes of groups such as Fathers 4 Justice. ”Fathers who have gone through divorce or separation will not be granted a legal right to guarantee that their child has “a meaningful relationship with both parents”, according to a long-awaited report on family law.”

Cases such as Gronow v Gronow and Kowaliw v Kowaliw continue to be cited as precedents, have been set in the curriculum of high school legal studies have more recently been added to the lists of significant Australian cases on Wikipedia. Decline in marriage hurting children: report

THE well-being of Australia’s children and young people has declined alarmingly in the past decade – and plunging marriage rates are partly to blame, a major study has found.

Its author, Patrick Parkinson, professor of law at the University of Sydney, has called for a review of government policy to ensure marriage is not being undermined. He says it is time to question whether the nation can afford to maintain policies that give neither encouragement nor support to marriage.

Abductions by a parent a ‘nightmare’

Two fathers who experienced the “nightmare” of having their sons taken from Australia by former partners have urged the federal government to make the act a crime.

Lauchlan Leishman and Ken Thompson fronted a Senate committee in Canberra on Friday, arguing that the system surrounding international child abductions needs a desperate overhaul.
